INVI MindHealth Terms & Conditions & Privacy Policy Effective date: February 7, 2023 The website https://www.invimh.com/ and related mobile application ("the Application") is owned and operated by INVI MindHealth (“Company,” “we,” “our,” or “us”). The Application provides a website and mobile application which allows certain users to measure certain parameters to track changes in a user’s physiological condition and other permitted users, such as health care providers or support person, access to such measured parameters for the health care applications or, more generally, the well-being of the user (the “Services”). Company does not meet the definition of a “business” under the California Consumer Privacy Rights Act and does not meet the requirements to be subject to the requirements of the Virginia Consumer Data Protection Act. Company does not direct products or services to residents of the United Kingdom or the European Economic Area. This Privacy Policy informs you of our policies regarding the collection, use, and disclosure of personal information when you use our Application and Services and the choices you have associated with that information. We collect your information only when you provide it to us or allow us to collect information from your designated devices, and we collect only the minimum amount of information necessary. We do not sell or rent your information to third parties. Information We Collect Personal Information While using our Services, we may ask you to provide us, or we may collect certain personally identifiable information that can be used to contact or identify you (“Personal Information”). We collect Personal Information that you choose to provide to us when you contact us to request information regarding our Services or when you otherwise use the Services. When you sign up for an account on the Application, we will collect your name, email address, telephone number, date of birth, physical address, and other information you may provide upon registering. You will also create a password for future logins. When you contact us through the Application, you will provide us with your email address and any other Personal Information you may choose to provide. Physical Data If you connect one or more mobile device or other wearable device, we may collect your height, weight, steps per day, heart rate, sleep data, respiratory rate, body temperature, and/or other body-related or physiological data which may be collected by your mobile device or other wearable device (collectively, the “Physical Data”). Analytical Data We also collect analytical information such as the time of your visit, pages visited, and time spent on each page of the webpages; referring site details; network location; and products you viewed, browser type, operating system, IP address, and mobile device information (collectively, “Analytical Data”). How We Use Your Information We use your Personal Information, Physical Data, Location Data and Analytical Data to provide you the Services, and to receive and respond to your inquiries about products, services, or support. To address your questions, we may subsequently need to request additional information. We may use your Personal Information to contact you about products or services that we believe may be of interest to you. We will use your Personal Information to register your account. We may share your Personal Information with service providers that perform tasks on our behalf related to our business, such as order fulfillment services, analytical services, marketing services that may provide you advertising on our behalf, bookkeeping, customer service, employment services, or social media services. We may disclose your Personal Information, Physical Data, Location Data and Analytical Data as required or appropriate by law, including to comply with legal process and to respond to requests from public and government authorities; to enforce our terms and conditions, including investigations of potential violations thereof; to detect, prevent, or otherwise address fraud, security, or technical issues; and to protect our operations. We may otherwise share or disclose your Personal Information, Physical Data, Location Data or Analytical Data with your consent.
